Bitte aufmerksam lesen: Wenn wir ein Shooting über die Model-Kartei vereinbaren, gelten die nachfolgenden Bedingungen als verbindlich vereinbart (Salvatorische Klausel: Die Ungültigkeit einer Regel schließt die anderen nicht aus). Wenn Du mit diesen Regeln nicht einverstanden bist, biete mir kein Shooting an.

1. Shooting-Basis & Honorar

Pay-Shootings: Mein maximal akzeptierter Stundensatz für erfahrene und ausdrucksstarke Pay Models liegt bei bis zu 80 €/Stunde. Eine Überschreitung dieses Rahmens ist ausschließlich für absolut außergewöhnliche Models mit hoher Reputation in der Szene möglich. Ich habe kein Problem mit Newcomern die Pay shooten aber bitte seid ehrlich zu Euch selbst, was ihr für Eure Erfahrung für Sätze nehmen könnt. Ich mag nicht handeln. Macht einfach von Anfang an ein faires Angebot.

TfP-Shootings: Können bei Interesse erfolgen, sofern das Model perfekt zu meinem Portfolio passt und professionell agiert.

2. Bereiche, Styling & Outfits

Bereiche: Ich fotografiere Porträt, Fashion, Beauty, Modern Boudoir und Lifestyle Nude und wir shooten nur jeweils maximal das, was wir vorher vereinbart haben. Mein Interesse ist im übrigen nicht so sehr Erotikfotografie. Ich bevorzuge Natürlichkeit ohne aufreizende Posen oder Mimik.

Styling & Visa: Wenn nicht ausdrücklich anders vereinbart, wird keine Visagistin gestellt. Ein angemessenes, normales Make-up und Styling wird vom Model vorausgesetzt.

Outfits: Bei vereinbarten Fashion-Shootings erwarte ich echte Fashion, die sich von alltäglicher Alltagskleidung abhebt (es geht nicht um teure Marken, einfach um gutes, fotogenes Styling). Eine vorherige Abstimmung der Outfits ist geboten.

3. Durchführung des Shootings, Pünktlichkeit & Studio-Buchungen

Wenn wir ein Outdoor Shooting vereinbaren, kennen wir die Wetterbedingungen am Tag des Shootings nicht. Wenn Du Outdoor Shootings anbietest, weisst Du damit umzugehen, dass es etwas nasser, etwas kälter oder etwas heisser sein kann als erwartet. Ich werde deshalb kein Shooting absagen, sondern Möglichkeiten suchen, wie wir trotzdem das eine oder andere gute Foto machen können. Sagst Du ab, besteht auch kein Anspruch auf Honorar.

Wenn für Indoor Shootings vom Fotografen hochwertige und teure Mietstudios exakt für den gebuchten Zeitraum bezahlt werden, ist Pünktlichkeit essenziell.

Trifft das Model erheblich zu spät ein, sodass das Studio kaum noch genutzt werden kann, gilt das Shooting als vom Model abgesagt. In diesem Fall erlischt jeglicher Anspruch auf ein vereinbartes Honorar.

4. Begleitperson

Eine Begleitperson ist herzlich willkommen, sollte jedoch bitte vorab angekündigt werden, muss sich am Set absolut unauffällig im Hintergrund aufhalten und wirklich vertrauenswürdig sein. Ich verstehe Bedürfnis nach Sicherheit. Aber bitte versteht auch, dass es auch für Fotografen ein ungutes Gefühl sein kann, wenn einfach jemand unbekanntes auftaucht und sich frei rund um teure Ausrüstung bewegt etc.

5. Bildrechte, Auswahl & Veröffentlichung

Nutzungsrechte Fotograf: Die entstandenen Fotos dürfen vom Fotografen uneingeschränkt, zeitlich unbegrenzt und unwiderruflich für eigene freie Projekte (z.B. Website, Social Media, Sedcards, eigene Printmedien, Eigenwerbung sowie Online- und Print-Wettbewerbe) verwendet und veröffentlicht werden.

Nutzungsrechte Model (TfP): Das Model erhält eine Auswahl der besten Fotos in bearbeiteter Version und darf diese im gleichen Umfang (Eigenwerbung) nutzen. Rohdateien (RAWs) werden grundsätzlich nicht herausgegeben.

Nutzungsrechte Model (Pay): Pay-Models können auf ausdrücklichen Wunsch Fotos für ihre Eigenwerbung erhalten.

Bildauswahl: Die Auswahl der Fotos erfolgt gewissenhaft und nach eigenem Ermessen durch mich. Als Daumenwert gelten 20–40 bearbeitete Fotos, es wird jedoch keine feste Garantie auf eine genaue Anzahl gegeben.

6. Urheber-Nennung & Verlinkung

Bei jeder Veröffentlichung durch das Model ist der Fotograf namentlich zu nennen und aktiv zu verlinken (Website, Instagram-Profil oder MK-Sedcard).

Das Model wird vom Fotografen auf ausdrücklichen Wunsch oder nach eigenem Ermessen genannt und verlinkt.

7. Status, Gewerbe & Abgaben

Das Model bestätigt, die Tätigkeit auf freiberuflicher bzw. gewerblicher Basis auszuüben, im Besitz eines gültigen Gewerbescheins (sofern erforderlich) zu sein und alle anfallenden Steuern und Abgaben ordnungsgemäß selbst abzuführen.

Sollten für den Fotografen durch die Buchung des Models gesetzliche Abgabenpflichten entstehen, ist das Model verpflichtet, den Fotografen bereits vor der Shooting-Zusage ausdrücklich und schriftlich auf dieses geltende Recht hinzuweisen.

8. Kommunikation über Dritte (Agenturen / Vermittler)

Erfolgt die Kommunikation (egal ob offen oder verdeckt) über eine Agentur, einen Agenten, einen Vermittler oder sonstige Dritte, liegt die alleinige Verantwortung für die vollständige und korrekte Übermittlung aller ausgetauschten Informationen (einschließlich dieser Regeln, Outfit-Absprachen, Zeit, Ort des Shootings etc.) auf der Seite des Models. Versäumnisse oder Informationsverluste durch Dritte gehen zu Lasten des Models.

1. Shoot Classification & Rates

Paid Shootings: My maximum accepted hourly rate for experienced and expressive pay models is up to €80. Exceeding this rate is only possible for absolute experienced premium models with strong reputation in the scene. I have no problem with newcomers doing paid shoots, but please be honest with yourselves about the rates you can charge given your level of experience. I don't like haggling. Just make a fair offer right from the start.

TfP Shootings: Time-for-Print shoots are based solely on my creative interest, provided that the model fits my portfolio perfectly and maintains a highly professional standard.

2. Genres, Styling & Outfits

Genres: I shoot portraits, fashion, beauty, modern boudoir, and lifestyle nudes, and we only shoot what we've agreed upon beforehand. My interest, by the way, is not so much in erotic photography. I prefer naturalness, without provocative poses or facial expressions.

Styling & MUA: Unless explicitly agreed otherwise, no makeup artist will be provided. A clean, normal standard of makeup and styling is required from the model.

Outfits: For fashion shoots, I expect actual fashion styles that stand out from ordinary, everyday clothing (it's not about expensive brands, only about photogenic styles). Prior coordination of outfits is welcome.

3. Punctuality, Conducting the shoot & Studio Bookings

When we schedule an outdoor shoot, we cannot know what the weather conditions will be like on the day. If you offer outdoor shoots, you know how to handle situations where it might be a bit wetter, colder, or hotter than expected. I will not cancel a shoot for this reason; instead, I will look for ways to capture some good photos regardless. If you cancel, you are not entitled to a fee.

When the photographer pays for high-quality, expensive rental studios for indoor shoots, they are specifically booked for the agreed time slot. Punctuality is essential.

If the model arrives significantly late, rendering the pre-paid studio time unusable, the shoot will be considered canceled by the model. In this case, any claim to the agreed model fee is forfeited.

4. Companions / Chaperones

An accompanying person is very welcome, but please notify me in advance; they must remain unobtrusively in the background while on set and be truly trustworthy. I understand the need for a sense of security. However, please also understand that it can be unsettling for a photographer when a stranger simply shows up and moves freely around expensive equipment, etc.

5. Image Rights, Selection & Delivery

Photographer’s Rights: The photographer retains the unrestricted, perpetual, and irrevocable right to use and publish all resulting images for personal projects, self-promotion, websites, social media, portfolios, print media, and competitions (online and print).

Model’s Rights (TfP): The model will receive a selection of the best images in a fully edited version and may use them to the same extent for self-promotion. Raw files (RAW) will not be provided.

Model’s Rights (Paid): Paid models can receive images for self-promotion upon explicit request.

Image Selection: Image selection is done conscientiously at my own discretion. As a rule of thumb, you can expect 20–40 edited photos, but there is no fixed guarantee on the exact number.

6. Credits & Tagging

For any publication by the model, the photographer must be credited and actively tagged (via Website, Instagram, or MK portfolio).

The model will be credited by the photographer either upon explicit request or at the photographer’s discretion.

7. Professional Status, Taxes & Duties

The model confirms that they operate on a freelance or commercial basis, possess a valid business registration (if applicable), and are solely responsible for filing and paying all resulting taxes and duties.

If the booking of the model triggers any statutory payment or levy duties for the photographer under applicable law, the model is required to explicitly inform the photographer in writing prior to confirming the shoot.

8. Communication via Third Parties (Agencies / Agents)

If communication is conducted (whether openly or covertly) through an agency, agent, mediator, or any other third party, the model bears sole responsibility for ensuring that all exchanged information (including these terms, outfit arrangements, time, location of the shoot, etc.) is transmitted completely and correctly. Any failure or loss of information caused by third parties shall be the sole responsibility of the model.
